Terms of Service

1. Who we are and what we do

Zimmerman Web Works LLC designs, builds, hosts, and maintains websites for small businesses. The specifics of any project, including scope, price, and timeline, are agreed with you directly before work begins. If a signed proposal or agreement for your project says something different from these Terms, the project agreement wins.

2. Consultations and inquiries

Consultations are free and come with no obligation. When you submit our booking form or call us, you're asking us to contact you about your inquiry. We'll use the contact details you provide for that purpose, as described in our Privacy Policy.

3. Text messaging (SMS) terms

You can cancel the SMS service at any time. Just text STOP. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Consent to receive text messages is not a condition of purchasing anything from us. If you'd rather not text, we're happy to work by phone or email. Our SMS privacy practices are described in our Privacy Policy.

4. Payments

Project prices are quoted up front and agreed before work begins. Unless your project agreement says otherwise, builds start with a deposit, and ongoing plans are billed monthly. If an invoice goes unpaid, we may pause work or hosting after giving you reasonable notice.

5. Your content and your data

Anything you give us to put on your website, such as text, photos, logos, and business information, stays yours. You're responsible for having the right to use what you provide. Your data is always yours: if we part ways, we'll hand over your content and site files in a usable form.

6. Our work

When a project is paid in full, you own the website we built for you. We keep the right to reuse general techniques, code libraries, and know-how that aren't specific to your business, and, with your permission, to show your finished site in our portfolio.

7. Acceptable use

Don't use this website or services we host for anything unlawful, deceptive, or harmful, including sending spam, distributing malware, or infringing someone else's rights. We may suspend service that's being abused.

8. Disclaimers and limitation of liability

This website is provided "as is". We work carefully, but we can't promise the site or any hosted service will be uninterrupted or error-free. To the fullest extent permitted by law, Zimmerman Web Works LLC is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us for the service the claim relates to in the twelve months before the claim arose. Nothing in these Terms limits liability that can't be limited under applicable law.

9. Governing law

These Terms are governed by the laws of the State of New York, without regard to its conflict of law rules. Any dispute will be handled in the state or federal courts located in New York.

10. Changes to these Terms

If we update these Terms, we'll post the new version here and update the date at the top. Meaningful changes to how texting works will also be communicated to you directly.
